Dear Members,

The Banks’ Failure To Pay Consequential Loss Under The FCA Redress Scheme

Some of you will be aware that Adrian Maurice of Pragmaticum and solicitors Mishcon de Reya (“Mishcon”) were working to bring a group action or actions against the banks regarding their failure to pay fair redress for Consequential Loss.

They have now just announced this initiative and we thought it appropriate that we should bring it to your attention as soon as possible.

Mishcon have confirmed that:
  • ·         there is a strong legal basis for taking action;
  • ·         claimants will not be required to pay any costs or fees other than those costs deducted from the settlement when won.
  • ·         the process will be transparent and well managed to ensure that the settlement amounts are maximised.

The proposition is simple and will be explained in more detail at a Conference that has been hastily arranged for this purpose on 13th March at the Aldersgate Room Central Halls, Westminster SW1.

We are acutely aware of the actions of certain banks to close out the FCA review process, and so see this as a last opportunity for those who feel they have not had fair redress for consequential loss.

After lunch the APPG have been given the platform. George Kerevan MP, Chairman will be speaking about its objectives and main activities.
